Protecting Your Assets With Pre- And Postmarital Agreements

Premarital agreements outline how property will be divided if the marriage does not work out. Postmarital agreements work the same way, but are drafted after entering into marriage. These agreements are often appropriate when one or both spouses bring significant assets to the marriage or want to protect themselves from the other’s debt.

Without a pre- or post-marital agreement, property acquired during your marriage is divided according to state law if you get divorced. In North Carolina, that means a family court judge will decide a “fair and equitable” division, which can be a subjective standard that removes control from your hands.
